Shortly before Atul Subhash was driven by a messy divorce to painful suicide in December 2024, we had been looking into Prenuptial Agreements (Prenups) for Indian couples. After the news became international headlines, we felt there is an urgent need to open the discussion about prenups and divorce in India.

It is possible a prenup could have prevented much of the suffering caused by this unfortunate incident.

Prenups in India exist in a grey area – they are not illegal, nor are they strictly enforceable like other contracts. We are actively working to change this. It requires an adjustment in the judicial view of marriage and partnership, and can be secured through legislative action such as a Uniform Civil Code.

We believe prenups between consenting adults should be fully legal, valid, and enforceable in modern India. Prenups prevent future conflict and protect the rights and interests of all parties better, including children born of the marriage and family members of the spouses. They could drastically reduce the instances of divorce, separation, harassment, and litigation, ultimately lifting a heavy burden from the judiciary and administration.

Recently, Family Courts have also changed their opinions on the validity of prenups, and have been increasingly admitting prenups in evidence to understand the intent and assets of the couple before marriage.

A Family Court in Delhi even said “Make prenuptial agreement compulsory.

“Time has come to make a compulsory prenuptial agreement to be executed before appointed authority after counselling of the parties about the possible risk of marriage going haywire for a variety of reasons,” said Hon’ble Judge Harish Kumar.

And so, we have been working to make prenups accessible and affordable for all couples.
